If you are 18 years of age or older, you may file form I-360 Petition for Amerasian, Widow(er), or Special Immigrant petition for a beneficiary (including yourself) who was born in Korea, Vietnam, Laos, Kampuchea, or Thailand after December 31, 1950, and before October 22, 1982, and was fathered by a U.S. citizen. A U.S. corporation may also file this petition for a beneficiary.

You can use Form I-360 Petition for Amerasian, Widow(er), or Special Immigrant to classify an alien as:

  • An Amerasian (born after Dec. 31, 1950, and before Oct. 23, 1982);
  • The widow(er) of a U.S. citizen;
  • A self-petitioning spouse or child of an abusive U.S. citizen or lawful permanent resident under VAWA;
  • A self-petitioning parent of an abusive U.S. citizen under VAWA; or
  • A special immigrant. We define a special immigrant as one of the following.
